PRIVACY POLICY

This privacy policy governs your use of the MobileH2O, LLC (MobileH2O) website and software application WiseH2O (“Application”) for mobile devices that was created by MobileH2O.  The Application is intended to provide water quality screening and observation annotation capabilities. 

User Provided Information 

The Application obtains the information you provide when you download and register the Application. 

When you register with us and use the Application, you generally provide (a) your name, email address, password and other registration information; (b) information you enter into our system when using the Application, such as contact information and water quality observation information; (c) transaction-related information, such as when you respond to any offers, or download or use applications from us; and (d) information you provide us when you contact us for help.

We may also use the information you provide us to contact you from time to time to provide you with important information, required notices and marketing promotions.

On occasion, MobileH2O, LLC may release non-personally-identifying information in the aggregate, e.g. by publishing a report on trends in the usage of its Website and Apps.

Automatically Collected Information 

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application. 

MobileH2O may collect personal information when you choose to download and use the Application in ways that require MobileH2O to gather such information, such as if you register as a user, add content using your phone, browse the Application, provide information or updates, or otherwise communicate with MobileH2O about the Application. When you input data to the Application, we may collect your user identification, the latitude and longitude of your location, and the time and date of the observation at that location.  The information collected is dependent on how the user interacts with the Application.  MobileH2O does not disclose personally-identifying information other than as described below, and you can always refuse to supply personally-identifying information, with the caveat that doing so may prevent you from engaging in certain website and application related activities.

Does the Application collect precise real time location information of the device?

When you visit the Application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the area you are located within and display a location map with relevant data.

Do third parties see and/or have access to information obtained by the Application?

Yes. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;

  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

  • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

  • if there is a bankruptcy, merger, acquisition, transfer of control, joint venture or other business combination involving MobileH2O.

What are my opt-out rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

How We Use Personal Information

MobileH2O uses personal information to provide Application services and administer and maintain the website. If you register as a user, you must provide current, accurate, complete, and up to date information.  We cannot and shall not be responsible for any problems or liability that may arise if you do not provide truthful, complete, and up to date information.

How We Disclose and Share Personal Information

Personal information used when posting observations are shared with other users through general usage of the Application.  We explicitly share this public information for certain observations with a handful of partners.

Personal information associated with users’ registration and account (name, email address, etc.) is shared with MobileH2O staff and representatives from MobileH2O partners. We may share IP addresses, user agents, and information relating to software stability and behavior with several analytics services. We do not share your MobileH2O user identification, username, email address, or name with any of these services. Some of those employees, contractors, and affiliated organizations may be located outside of your home country; by using MobileH2O’s website or apps, you consent to the transfer of such information to them.

If you are a registered user of MobileH2O and have supplied your email address, MobileH2O may occasionally contact you to inform you about new features, solicit your feedback, or keep you informed about the MobileH2O website and app. If you send us a request for support or via a feedback mechanism, we reserve the right to publish it in order to help clarify or respond to your request or to help support other users.

How We Retain Personal Information

We retain your personal information associated with your registration for so long as you remain a registered user of the Application. In addition, we may retain personal information from closed accounts to comply with national laws, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Service and take other actions permitted or required by applicable national laws.

Some Personal Information associated with observations (time, date, location, etc.) may remain attached to observations, even after you have closed your account.

Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us. We will delete such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy.  You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information.
